Incendio Trading Limited – Corporate Liability & Disclaimers

This page outlines the overarching liability frameworks, statutory exclusions, and disclaimer policies for Incendio Trading Limited ("Incendio") and its corporate directors, officers, and agents.

1. Overarching Limitation of Liability

To the maximum extent permitted by New Zealand law, Incendio Trading Limited, its directors, officers, employees, and agents shall not be liable to any user, business, or third party for any direct, indirect, incidental, consequential, or special financial losses, damages, or expenses. This includes, but is not limited to, loss of profits, loss of data, business interruption, or personal financial losses resulting from the use of our corporate website or any of our standalone software products.

2. Shielding of Personal Liability

Incendio Trading Limited operates strictly as a separate legal entity. Under no circumstances shall the sole shareholder, director, or individual software developers behind Incendio be held personally liable for corporate obligations, software bugs, calculation variations, or data anomalies arising from our applications.

3. Fair Trading Act and Consumer Law Exclusions

We fully acknowledge our statutory obligations under the New Zealand Fair Trading Act 1986 and Consumer Guarantees Act 1993 for standard individual consumers. However:

• Our applications are software tools meant to illustrate mathematical scenarios based on user-inputted data. They do not constitute regulated financial advice.
• Commercial and Business Users: If any Incendio application or corporate asset is accessed or utilized "in trade" (such as by financial advisors, commercial enterprises, or corporate entities using tools for commercial gain), we explicitly contract out of the Consumer Guarantees Act 1993 and Sections 9, 12A, and 13 of the Fair Trading Act 1986 to the fullest extent permitted by law.

4. Product-Specific Caps

Any liability limitations regarding our individual software tools (such as the RetireMe application) are explicitly capped at the product tier level—restricting aggregate claim payouts to the greater of the subscription fee paid by the user over the preceding 12 months or NZD $100.
